Nike'S Application For Registration, Liu Xiang'S Trademark Denied

The application for registration of the "Liu Xiang" trademark was rejected because a company registered the trademark 26 years ago.

Nike brought the judges to the court.

This morning, a middle court heard the case.


In July 1986, a family name was

Liu Xiang Industrial Co., Ltd. applied for the registration of the "Liu Xiang brand" to the business judges. The categories of applications for registration are clothing, and the exclusive right of trademark is limited to 2017.


The "Liu Xiang" trademark happens to be the same name as Liu Xiang, who is known as "flying fly" after that.

At that time, Liu Xiang was only 3 years old.


Since then, Nike has proposed the registration of "Liu Xiang" as a trademark to the business jury, and has not been approved by the business jury.


According to the business committee, the "Liu Xiang" trademark in Shanghai Liu Xiang Industrial Co., Ltd. has a significantly weaker saliency. The two word "Liu Xiang" is most easily remembered and recognized.

Therefore, Nike's application for registration of the "Liu Xiang" trademark makes it easy for ordinary consumers to misunderstand that there is a correlation between them. Both of them are used in clothing products, so the jury rejected Nike's application.


"Liu Xiang has a high reputation in China and even in the world. His name has enormous commercial value and economic interests. His right to name and its merchandising right should be protected by law."

Nike believes that by Liu Xiang's legal authorization, the company has the right to commercialize the use of Liu Xiang's name and image as a trademark.

With the huge popularity and the global influence of Nike, consumers will not confuse the "Liu Xiang" trademark applied by Nike with the first "Liu Xiang" brand.


The agent of the Business Council insisted that no matter how high Liu Xiang's popularity was, he could not infringe on the right of the prior trademark.

The committee did not comment on Liu Xiang's use or commercialization of his right to name.


"Do you recognize Liu Xiang's popularity in the Chinese sports world?" Jiang Ying, the famous intellectual property judge, inquired the agent of the jury.

The agent of the business jury replied, "recognition."

But the agent insisted that Nike could not register the "Liu Xiang" trademark.


According to Nike agents, Nike first foresaw the huge economic value of Liu Xiang. He signed with Liu Xiang before he became famous in 2004, and applied for registration of a series of trademarks specially designed for Liu Xiang, mainly including "liuxiang", "LX" and the figure of flying men hurdling.

Liu Xiang is still one of the best men's 110 meter hurdles.
